2. Artwork and product information
I make every effort to ensure that photographs, descriptions, colours, dimensions and other information about my artwork are accurate.
However, colours may appear slightly different depending on your screen or device.
Where artwork is handmade or individually created, there may be small variations between pieces. These variations are part of the character of handmade artwork and are not considered defects.
I reserve the right to correct errors or inaccuracies in product descriptions, prices or availability.
3. Availability
All artwork is subject to availability.
Because some pieces may be original or one-of-a-kind artworks, an item may become unavailable before an order can be processed.
If I am unable to fulfil an order you have placed, I will contact you and provide an appropriate refund where necessary.
4. Prices
All prices displayed on the website are in pounds sterling (£) unless otherwise stated.
The price applicable to your order is the price displayed on the website at the time you place your order.
Delivery charges, where applicable, will be shown before you complete your purchase.
5. Payment
Payment is made through the payment options available at checkout, which may include Stripe and PayPal.
Payment must be successfully received before an order is processed and dispatched.
I do not normally have access to or store your full payment card details.
6. Placing an order
When you place an order, you are making an offer to purchase the artwork or product selected.
After placing an order, you should receive an order confirmation by email.
An order confirmation does not necessarily mean that the order has been accepted if there is an error with the product, price or availability.
I reserve the right to cancel an order where there is a genuine error, the item is unavailable, or there is another reasonable circumstance preventing me from fulfilling the order.
If I cancel an order after payment has been taken, you will receive a full refund.
7. Delivery
I will aim to dispatch your order within the timeframe stated on the relevant product page or during checkout.
Delivery times can vary depending on the destination and delivery service used.
Once an order has been dispatched, delivery is carried out by the relevant postal or courier service.
You are responsible for providing an accurate delivery address.

8. Damaged artwork or products
I take care when packaging artwork for delivery.
If your order arrives damaged, please contact me as soon as possible at:
Please provide photographs of the damaged artwork and packaging where possible. This will help me assess the issue and, where appropriate, make a claim with the delivery provider.
I will work with you to resolve the problem in accordance with your legal rights.
9. Your right to cancel an order
If you are a consumer purchasing online, you may generally have the legal right to cancel your order within 14 days of receiving the goods, without giving a reason.
You must then return the goods within the applicable legal timeframe.
This cancellation right may not apply to certain goods, including items that are made to your specifications or clearly personalised.
Nothing in these Terms & Conditions affects your statutory consumer rights.

Returned items should be sent back in appropriate condition and, where possible, in their original packaging.
Unless the item is faulty, damaged or otherwise not as described, you may be responsible for the cost of returning an item where the law allows.
Refunds will be made using the original payment method where reasonably possible.
Your statutory rights are not affected by this returns policy.
11. Faulty, damaged or incorrectly supplied items
If an artwork or product is faulty, damaged on arrival or does not match what you ordered, please contact me as soon as possible.
You may have legal rights to a repair, replacement, refund or other remedy depending on the circumstances.
Nothing in these Terms & Conditions limits or excludes your rights under applicable consumer protection law.
12. Original artwork and copyright
Unless otherwise stated, all artwork, photographs, illustrations, designs, written content and other creative material displayed on www.eleanordaisy.com belongs to Eleanor Daisy or is used with permission.
Purchasing an artwork does not transfer copyright or other intellectual property rights in the artwork to the buyer.
You may not reproduce, copy, scan, digitally reproduce, sell or commercially exploit my artwork without my prior written permission.
The physical artwork purchased belongs to the customer, but the copyright remains with me unless otherwise agreed in writing.
13. Website use
You agree not to misuse this website or attempt to interfere with its security, operation or functionality.
I may restrict or suspend access to the website where reasonably necessary to protect the website, my business or other users.
14. Limitation of liability
I will take reasonable care in providing my website and fulfilling orders.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for fraud, death or personal injury caused by negligence, or your statutory consumer rights.

Personal information provided when you use my website or place an order is handled in accordance with my Privacy Policy.

Any disputes will be subject to the applicable courts of England and Wales, subject to any mandatory consumer rights that may apply.
